By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, you must immediately discontinue use of the Service.
1. Eligibility and User Responsibility
You must be at least 18 years old and have the legal capacity to use the Service. You alone are responsible for determining whether using the Service and completing a swap is lawful, permitted, and reportable in your jurisdiction.
SWAPPED.GG does not monitor, direct, approve, endorse, or assume responsibility for the purpose for which any user initiates a swap.
2. Aggregator Only
SWAPPED.GG is a non-custodial swap aggregator and software interface. The Service requests, compares, displays, and routes swap information or orders to independent liquidity providers, protocols, APIs, smart contracts, blockchain networks, bridges, and other third-party infrastructure.
SWAPPED.GG is not an exchange, broker, dealer, bank, money transmitter, fiduciary, financial adviser, custodian, counterparty, guarantor, or agent for any user or third-party provider. A displayed quote is indicative until accepted and processed by the applicable provider. Prices, fees, availability, routes, deadlines, and output amounts may change or become unavailable at any time.
SWAPPED.GG does not control third-party providers and does not guarantee that any route, quote, provider, asset, network, or transaction will remain available or complete successfully.
3. Non-Custodial Operation
SWAPPED.GG does not hold, possess, custody, own, or control user wallets, private keys, seed phrases, or digital assets. Assets are transferred directly according to user-submitted instructions and the operation of the selected third-party route.
You are solely responsible for securing your devices and wallets, verifying every asset, network, amount, recipient address, refund address, memo, tag, deadline, and transaction detail, and maintaining access to your private keys and recovery material.
4. User Instructions and Finality
Every swap is initiated solely by you. SWAPPED.GG may rely conclusively on the information and instructions you submit and has no duty to verify ownership, identity, intent, destination, suitability, accuracy, or authority.
Blockchain transactions may be irreversible. Incorrect addresses, networks, assets, amounts, memos, tags, or other instructions may cause permanent loss. SWAPPED.GG cannot reverse, cancel, recover, refund, or modify a transaction after it has been submitted to a provider or network.
5. No Advice or Fiduciary Duty
Nothing made available through the Service is financial, investment, trading, legal, tax, accounting, compliance, security, or other professional advice. SWAPPED.GG owes no fiduciary duty or duty of care in connection with any quote, route, transaction, asset, provider, or user decision.
6. Third-Party and Blockchain Risks
You accept all risks involving third-party providers and blockchain technology, including price volatility, slippage, liquidity shortages, stale or inaccurate quotes, failed or partial execution, delays, congestion, reorganization, forks, validator failure, bridge failure, smart-contract defects, protocol exploits, API outages, cyberattacks, software defects, regulatory action, and permanent loss of assets.
Third-party services are independent from SWAPPED.GG. Their actions, omissions, terms, security, solvency, performance, availability, and compliance are outside SWAPPED.GG's control and are not endorsed or guaranteed by SWAPPED.GG.
7. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL QUOTES, ROUTES, DATA, CONTENT, AND FUNCTIONALITY ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS."
SWAPPED.GG DISCLAIMS ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AVAILABILITY, QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
SWAPPED.GG DOES NOT WARRANT THAT THE SERVICE WILL BE CONTINUOUS, SECURE, TIMELY, ERROR-FREE, VULNERABILITY-FREE, OR THAT ANY QUOTE OR TRANSACTION WILL BE ACCURATE, AVAILABLE, COMPLETED, REFUNDED, OR PROFITABLE.
8. Assumption of Risk and Release
YOU VOLUNTARILY ASSUME ALL RISKS ARISING FROM OR RELATING TO THE SERVICE, YOUR WALLETS, YOUR INSTRUCTIONS, THIRD-PARTY PROVIDERS, BLOCKCHAIN NETWORKS, DIGITAL ASSETS, AND EACH SWAP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE AND DISCHARGE SWAPPED.GG AND ITS OWNERS, OPERATORS, AFFILIATES, CONTRIBUTORS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND PARTNERS FROM ALL CLAIMS, DEMANDS, LOSSES, LIABILITIES, DAMAGES, COSTS, AND CAUSES OF ACTION, WHETHER KNOWN OR UNKNOWN, ARISING FROM OR RELATING TO THOSE RISKS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWAPPED.GG AND ITS OWNERS, OPERATORS, AFFILIATES, CONTRIBUTORS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND PARTNERS SHALL NOT BE LIABLE UNDER ANY THEORY OF LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR STATUTORY DAMAGES; LOSS OF FUNDS, DIGITAL ASSETS, PROFITS, REVENUE, BUSINESS, DATA, USE, OR GOODWILL; OR ANY FAILED, DELAYED, STUCK, PARTIAL, MISROUTED, EXPLOITED, OR OTHERWISE UNSUCCESSFUL TRANSACTION.
These exclusions apply whether a claim arises in contract, tort, negligence, strict liability, statute, equity, restitution, or otherwise; whether damages were foreseeable; and even if SWAPPED.GG was advised of their possibility.
IF LIABILITY CANNOT BE EXCLUDED, THE TOTAL AGGREGATE LIABILITY OF SWAPPED.GG AND ALL RELATED PARTIES FOR ALL CLAIMS SHALL NOT EXCEED THE FEES, IF ANY, ACTUALLY RETAINED BY SWAPPED.GG FROM THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM. YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE SERVICE IS TO STOP USING IT.
Some jurisdictions do not permit certain exclusions or limitations. In those jurisdictions, each exclusion and limitation applies only to the maximum extent permitted by applicable law.
10. No Platform-Specific Activity Restrictions
SWAPPED.GG does not impose a platform-specific prohibited-activities policy and does not investigate or assume responsibility for a user's purpose. This statement does not authorize conduct that is unlawful under laws applicable to the user. Each user remains solely responsible for their own conduct, legal compliance, taxes, reporting, and consequences.
11. No Individual User Suspension
SWAPPED.GG does not operate user accounts and will not suspend, restrict, or terminate an individual user. This does not guarantee continuous access to the website or any route. Service-wide maintenance, outages, security incidents, provider decisions, network conditions, technical limitations, or events beyond SWAPPED.GG's control may affect availability for everyone.
12. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless SWAPPED.GG and its owners, operators, affiliates, contributors, employees, contractors, service providers, and partners from every third-party claim, demand, investigation, action, liability, judgment, damage, loss, cost, and expense, including reasonable legal fees, arising from or relating to:
- Your access to or use of the Service;
- Your wallets, funds, instructions, transactions, or disputes;
- Your breach of these Terms;
- Your violation of another person's rights or any law applicable to you; or
- Any information or instruction you submit through the Service.
13. Changes to the Service or Terms
SWAPPED.GG may change the Service or these Terms at any time. Updated Terms become effective when published. Continued use after publication constitutes acceptance of the updated Terms.
14. Severability, No Waiver, and Entire Agreement
If any provision is held invalid or unenforceable, it shall be enforced to the maximum extent permitted and the remaining provisions remain effective. Failure to enforce any provision is not a waiver. These Terms are the entire agreement between you and SWAPPED.GG concerning the Service and supersede prior statements or agreements on that subject.
